Searching and Booking
1.1 Searching
You can search for Accommodations and Services using criteria such as the type of service, listing, travel destination, travel dates, and number of guests. Filters are available to refine your search results. Results are based on their relevance to your search criteria, considering factors like price, availability, reviews, customer service and cancellation history, popularity, previous trips, saved listings, and host requirements (e.g., minimum or maximum nights).
1.2 Booking
When you book a listing, you agree to pay all charges associated with your booking, including the listing price, applicable fees like Vercasa Srl’s service fee, offline fees, taxes, and any other items identified during checkout (collectively, the “Total Price”). If you choose to pay in a currency different from that set by the host, the price displayed will be based on our currency conversion rate. You also agree that Vercasa Srl, via Stripe, may charge the payment method used for the booking to collect Damage Claim amounts.
Upon receiving the booking confirmation, a contract for Services (a "Reservation") is formed directly between you and Vercasa Srl. By making a Reservation, you agree to the contract terms, which include these Terms, all terms of the Reservation, the cancellation policy, and any other rules, standards, policies, or requirements identified in the listing or during checkout. It is your responsibility to read and understand all terms of the contract, including these Terms and all reservation rules, standards, policies, and requirements before booking. Please see the Rental Rules in Exhibit A below.
1.3 Accommodation Reservations
An Accommodation Reservation grants you a limited license to enter, occupy, and use the accommodation. The host retains the right to re-enter the accommodation during your stay if it is reasonably necessary, permitted by your contract with the host, and allowed by applicable law. If you stay past checkout, the host has the right to make you leave in accordance with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed guests.
1.4 Reservations for Experiences and Services
A reservation for an experience or other service allows you to participate in, attend, or use that service. You are responsible for ensuring that you and anyone you invite meet the minimum age, proficiency, fitness, or other requirements. You must inform the host of any medical or physical conditions or other circumstances that may impact your ability to participate. Unless expressly authorized, you may not allow any person to join an experience or service unless they are included as an additional guest during the booking process.
Cancellations, Refunds, Reservation Issues, and Booking Modifications
2.1 Cancellations, Refunds, and Reservation Issues
Generally, if you cancel a reservation, the refund amount is determined by the cancellation policy for that reservation. However, in certain situations, other policies may determine the refund amount. If you need to cancel due to circumstances beyond your control, you might be eligible for a partial or full refund under our Extenuating Circumstances Policy. If the host cancels, or if you encounter a reservation issue (as defined in our Rebooking and Refund Policy), you could be eligible for rebooking assistance or a refund under the Rebooking and Refund Policy. Specific policies apply to different types of listings; for example, Experience Reservations are covered by the Experiences Guest Refund Policy. Refer to each relevant policy or additional legal term for details on coverage and applicable refunds. You may appeal a Vercasa Srl decision by contacting our customer service.
2.2 Booking Modifications
Guests and hosts are responsible for any booking modifications they agree to make via the Vercasa Srl platform or by directing Vercasa Srl customer service to make on their behalf ("Booking Modifications"). They also agree to pay any additional amounts, fees, or taxes associated with any booking modification.
Your Responsibilities and Assumptions of Risk
3.1 Your Responsibilities
You are responsible and liable for your own actions and omissions, as well as those of anyone you invite to join or provide access to any accommodation, common areas, or services. Specifically: (i) You are responsible for leaving the accommodation (and related personal property) or common areas in the same condition as when you arrived. (ii) You are responsible for paying all reasonable damage claim amounts. (iii) You must act with integrity, treat others with respect, and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or bringing a minor to an experience or service, you must be legally authorized to act on behalf of the minor and are solely responsible for supervising the minor.
3.2 Your Assumption of Risk
You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume all risks arising from your use of the Vercasa Srl platform and any content (as defined in Section 9). This includes your stay at any accommodation, participation in any experience, use of any other service, or any interaction with other members, whether in person or online. It is your responsibility to investigate a service to determine if it is suitable for you. For example, experiences and services may carry risks of illness, bodily injury, disability, or death, which you freely and willingly assume by choosing to participate.
Fees
Vercasa Srl may charge fees (and applicable taxes) to Guests for the right to use the Vercasa Srl platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Any applicable fees are disclosed to Guests before making a booking. Except as otherwise provided on the Vercasa Srl platform, service fees are non-refundable. Vercasa Srl reserves the right to change the service fees at any time and will notify Members of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change.
Modifications
Vercasa Srl may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Vercasa Srl platform and update the "Last Updated" date at the top of these Terms. We will also notify you of any material changes by email, notifications through the Vercasa Srl platform, messaging service, or any other contact method made available by us and selected by you, at least 30 days before the changes become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the revised Terms become effective, your continued access to or use of the Vercasa Srl platform will constitute acceptance of the revised Terms.
Resolving Damage Claims and Complaints
If a Vercasa Srl is presented with valid evidence that you, your guest(s), or your pet(s) have:
(i) damaged the complaining homeowners real or personal property, or real or personal property the complaining homeowner is responsible for or has an economic interest in; or
(ii) caused loss of booking income for bookings via the Vercasa Srl platform or other consequential damages which result directly from the damage caused under (i) above; or
(iii) otherwise caused the complaining homeowner to incur cleaning costs in excess of the cleaning fee (each of (i), (ii), and (iii) being a "Damage Claim"),
The complaining homeowner can notify Vercasa Srl and/or seek compensation through the Resolution Center. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Vercasa Srl and Vercasa Srl determines in its sole discretion that the Damage Claim is valid and you are responsible for the Damage Claim, Vercasa Srl via Stripe Payments can collect the amount of the Damage Claim from you. You agree that Vercasa Srl may seek to recover from you under any insurance policies you maintain and that Vercasa Srl may also pursue any remedies available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against you. You agree to cooperate in good faith, provide any information Vercasa Srl requests, execute documents, and take further reasonable action in connection with Damage Claims, homeowner complaints, claims under insurance policies, or other claims related to your provision or use of services.
Limitations on Liability
Neither Vercasa Srl (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Vercasa Srl platform or any content will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, loss of goodwill, service interruption, computer damage or system failure, the cost of substitute products or services, or any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Vercasa Srl platform or any content, (iii) any communications, interactions, or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Vercasa Srl platform, or (iv) publishing or booking of a listing, including the provision or use of Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Vercasa Srl has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.
These limitations of liability and damages are fundamental elements of the agreement between you and Vercasa Srl. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.
RENTAL RULES
Smoking is allowed outside only.
People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of the Guest.
The Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. A safe is available in the property on request (free of charge). By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Keep the property and all furnishings in good order.
Only use appliances for their intended uses.
Pets are NOT allowed.
Housekeeping: There is no daily housekeeping service unless expressly booked as an added service at the time of reservation.
